SKIHEART® is a registered trademark of Skiheart Inc. SKIHEART® and its online variations (SkiHeart.com, SkiHeart.net, and SkiHeart.org) shall be referred to as SKIHEART® in the following terms and conditions:

SKIHEART® does not sell any products.

We are an online news service only. Any questions about products, services or ski or snowboard resorts should be directed to the retailer/resort who has sold you the product or service. Skiheart reserves the right at its sole discretion to modify or change any or all of these terms and conditions at any time.

In addition, SKIHEART® may change, discontinue or suspend any or all aspects of its services at any time without any prior notice or liability.

Limitation of Liability

SKIHEART® is not liable for any typographical errors or omissions contained in the content of its website or any websites linked from SKIHEART®. Content can change quickly and SKIHEART® gives no warranty as to the accuracy of the content of its website or any websites linked from SKIHEART®.

Any consumer who uses Skiheart content shall be at his or her own risk. All transactions made based on information from Skiheart services are only between you and the Vendor; SKIHEART® shall not be a party to any such transaction.

All claims, causes of action, rights and remedies of the consumer shall be solely against the vendor; SKIHEART® shall not be a party to any such claims or causes of action.

In consideration of using the services of SKIHEART®, you agree that SKIHEART® has no liability for any costs, delivery, failure to deliver, performance, failure to perform, quality, damage, services, or products ordered or attempted to be ordered based on the content gained from Skiheart.

SKIHEART® does not assume any liability and shall not be responsible for any use of the products listed or advertised on SKIHEART®. This includes any damages or personal injuries incurred as a result of using skiing or snowboarding products.

SKIHEART® makes no warranties of any kind, either expressed or implied, including without limitation, implied warranties of merchantability, a particular purpose or non-infringement, regarding the products listed and/or advertised on SKIHEART®’s websites or any websites linked from SKIHEART®.

SKIHEART® does not warrant that its services will be uninterrupted, or free from errors, omissions or viruses. SKIHEART® does not make any warranty as to the results to be obtained from the use of its services or its content.

SKIHEART® shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of the use or inability to use SKIHEART®’s services or the products and services of listed on websites linked from SKIHEART®. The services & content provided by SKIHEART® are distributed on an “as is” and “as available” basis.

SKIHEART®’s solution for any dispute related to the use of any SKIHEART® website, product or service is your cessation of the use of the Skiheart.com website. SKIHEART® does not assume any liability for any unauthorized or fraudulent use of this site.

Submissions to the SkiHeart.com Site

All emails, correspondence, phone calls, products and communications and the content thereof sent to the SKIHEART® website shall become property of Skiheart Inc. In addition, all communications sent to SKIHEART® can be posted on the SKIHEART® website at SKIHEART®’s sole and absolute discretion. There will be NO compensation paid to the sender of such communications. There is no fiduciary relationship between such sender and SKIHEART®. You acknowledge that any communication that is sent to SKIHEART® is not confidential and can be disclosed to third parties.

Indemnification

By using the Skiheart.com website or its variations, Skiheart.org or Skiheart.net, you agree to indemnify, defend and hold Skiheart Inc., its subsidiaries, affiliates, contractors, and their respective directors, officers, employees and agents from and against all claims and expenses, including attorney’s fees, arising out of your use of this site. If you do not agree to be bound by all of the above terms and conditions, do not use the Skiheart.com, Skiheart.org or Skiheart.net websites.
